To apply for a domestic violence order

  • Application for Domestic Violence Order
  • Affidavit
  • Service Information Form

Guideline for drafting an affidavit

This information is a guide only and should not be used as a substitute for individual legal advice

  1. DO NOT use your address or that of where you are staying if you do not want the other person to know it.
    • Use “ADDRESS WITHHELD”
  2. Use paragraphs and number each paragraph;
  3. Detail the relationship:
    • Husband, Wife, defacto partner etc
    • Relationship length
    • (ie: May 2011-June 2013 or started in 2003, married in 2008 and separated in 2013)
  4. Are there any children of the relationship?
    • Give their names and dates of birth
  5. Are there any Parenting Plans, Family Law Orders or other agreements for the children:
    • provide brief overview of arrangement including change­overs
    • (ie: children spent every second weekend with the other party)
  6. Provide one or two sentences that describe the kinds of domestic violence the other person has been doing to you:
    • If it involves text, email messages, verbal abuse or Facebook posts, use the exact words in quotations
    • (ie: Text 04/04/14: “I’m going to smash you, you fucking dog”)
  7. Details of the most serious domestic violence incident:
    • Include dates if known
    • Can use approximate dates
    • (ie: Around the beginning of January 2012 or around Christmas 2012)
    • If text etc, set out like paragraph 6
    • Put in if the incident was reported to Police
    • Were there any injuries and did you get medical attention
    • How did it make you feel
  8. Details of the most recent domestic violence incident:
    • See paragraph 7
  9. What are your fears for the future if the court does not give you a domestic violence order.
